1. Acceptance of Terms

By downloading, installing, or using CrateDigger ("the Software"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Software. CrateDigger is operated by Korey Armstrong ("we," "our," or "us"). Your use of the Software is also governed by our Privacy Policy, which is incorporated into these Terms by reference. You must be at least 13 years of age to use the Software. By using CrateDigger, you represent that you are at least 13 years old.

2. Description of Service

CrateDigger is a desktop application that provides audio metadata management tools for DJs, including:

  • BPM and musical key detection
  • Audio fingerprint-based track identification (auto-tagging)
  • Duplicate file detection
  • Batch file renaming and tag standardization
  • Library health reporting and bitrate scanning
  • Custom genre management
  • Folder monitoring for automatic imports

3. User Accounts

To access certain features, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Promptly notify us of any unauthorized use of your account
  • Accept responsibility for all activities under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscription and Payments

Free Tier

The free tier includes core features with limited auto-tagging (5 tags per month). No payment information is required.

Pro Tier

Pro subscriptions are billed monthly at $14.99 USD through our payment processor, Polar.sh. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.

Cancellation

You may cancel your subscription at any time through your account settings or the customer portal. Cancellation takes effect at the end of your current billing period. No refunds are provided for partial billing periods. If you are located in the European Union, you may have a right of withdrawal within 14 days of purchase, provided you have not used any auto-tag credits during that period. Refund requests are processed through our payment provider, Polar.sh.

Usage Limits

Auto-tag usage resets on your account anniversary date. Unused tags do not roll over.

5. Acceptable Use

You agree not to:

  • Use the Software for any illegal purpose
  • Attempt to circumvent usage limits or subscription restrictions
  • Reverse engineer, decompile, or disassemble the Software
  • Share your account credentials with others
  • Use automated systems to abuse the auto-tagging feature
  • Interfere with or disrupt the Software or servers
  • Violate the intellectual property rights of others

6. Intellectual Property

CrateDigger™ and its original content, features, and functionality are owned by Korey Armstrong and are protected by international copyright, trademark, and other intellectual property laws. CrateDigger™ is a trademark of Korey Armstrong. All other trademarks, logos, and brand names are the property of their respective owners.

Your audio files and metadata remain your property. We do not claim ownership of any content you process using the Software.

CrateDigger is not affiliated with, endorsed by, or sponsored by Pioneer DJ (Rekordbox), Serato, Native Instruments (Traktor), or any other DJ hardware or software manufacturer. All third-party product names are trademarks of their respective owners.

7. Third-Party Services

The Software integrates with third-party services including:

  • ACRCloud - For audio fingerprinting and metadata lookup
  • Supabase - For authentication and data storage
  • Polar.sh - For payment processing

The Software requires an internet connection for account verification, auto-tagging, and metadata retrieval. Offline functionality is limited to features that do not depend on third-party services, such as BPM detection, key detection, and duplicate finding.

Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the availability or accuracy of third-party services.

8. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Implied warranties of merchantability and fitness for a particular purpose
  • Accuracy or completeness of auto-tagging results
  • Uninterrupted or error-free operation
  • Compatibility with your specific audio files or DJ software

BPM and key detection are based on algorithmic analysis and may not always be 100% accurate. Musical key results (e.g., Camelot, Open Key, or standard notation) are estimates provided for convenience and should be verified by the user. We recommend verifying all critical metadata before professional use.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KOREY ARMSTRONG SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SOFTWARE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SOFTWARE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS LESS.

10. Data and File Safety

CrateDigger modifies audio file metadata (ID3 tags, Vorbis comments, etc.) directly on your files. While we take precautions to ensure safe operation:

  • We recommend backing up your files before batch operations
  • We are not responsible for data loss or file corruption
  • Changes to metadata cannot always be undone

CrateDigger is a library management tool, not a backup solution. You are responsible for maintaining a master copy of your music library. We strongly recommend keeping a separate backup of all audio files before using batch operations such as renaming or tag standardization.

11. Audio Content and Copyright

CrateDigger does not store, host, stream, or distribute audio content. The Software reads audio files stored locally on your device to analyze metadata such as BPM, key, and audio fingerprints. Audio fingerprints are sent to third-party services solely for the purpose of identifying track metadata.

You are solely responsible for ensuring that you have the legal right to possess and process the audio files in your library. We are not responsible for any copyright infringement or other legal violations arising from your use of the Software with unauthorized content.

12. Indemnification

You agree to indemnify, defend, and hold harmless Korey Armstrong from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of the Software; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property or privacy rights; or (d) any content you process using the Software.

13. Updates and Changes

We may update the Software and these Terms from time to time. Continued use of the Software after changes constitutes acceptance of the new Terms. We will make reasonable efforts to notify users of significant changes.

We reserve the right to modify, suspend, or discontinue any aspect of the Software at any time.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the state or federal courts located in the State of New York.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
